| This "Acceptable
Use Policy" ("Policy") details the acceptable
uses of eVise, Inc. ("eVise") products and services.
This policy applies to all of its clients, assignees and other
users (collectively, "Client"). This Policy is intended
to ensure the security, integrity, privacy, and reliability
of the eVise infrastructure (servers, network, systems, applications,
products, services, server hosting facilities, etc.). eVise
may modify this Policy from time to time as the security, infrastructure
and business environments change. Any changes made to this
policy will be considered effective upon the posting of the
modified Policy to this web site. The policy will continue
to be posted at this page, unless notification otherwise has
been made.
It is and will continue to be the responsibility of the
Client to ensure continuous compliance of the acceptable
use of eVise infrastructure that this Policy details, as
well as any modifications made and posted to this site in
the future.
Legal Use of Infrastructure: The eVise Infrastructure is
to be used for lawful purposes only, and may not be used
to perform, aid in the performance or abet the performers
of illegal activities of any kind. The eVise Infrastructure
is not to be used to make, type, or create; send, transmit,
forward, or broadcast; disseminate, distribute, or circulate;
house, save or store any material or data which may: (a)
Violate any copyright, trademark, proprietary information,
trade secret, or other intellectual ownership rights. (b)
Violate personal or business privacy and/or publicity. (c)
Violate laws, ordinances or regulations for exports. (d)
Abuse, threaten abuse or harm, or infer hatred of any kind.
(e) Support or promote criminal behavior or actions. (f)
Create potential for civil liability. (g) Violate any policy
or regulation set by eVise, other service providers, or government
agencies. (h) Disrupt the normal technical and procedural
operations of the eVise Infrastructure, which includes but
is not limited to the introduction or proliferation of worms,
viruses, Trojan programs or any other vicious or destructive
devices. (i) Weaken or damage communication privacy. (j)
Deceive other individuals, organizations, or companies. (k)
Be considered pornographic or obscene in nature. (l) Aid
or abet any individual or organization engaging in any of
the above.
Client is obligated to notify eVise immediately if it becomes
aware of or receives information regarding any such activities.
Client is further obligated to take any other appropriate
action(s) to stop such activities.
eVise Infrastructure Security: Violation, or attempting
to violate, eVise infrastructure security is strictly forbidden.
Any violations or violation attempts will result in criminal
and civil liabilities to the Client and/or client's responsible
assignees/employees. eVise will cooperate with law enforcement
agencies and will investigate all alleged violations in the
event of suspected violations. Violations of the security
of the eVise Infrastructure include, but are not limited
to the following: (a) Accessing, attempting to access or
granting access to data not intended for such Client. (b)
Accessing any portion of the eVise infrastructure to which
Client is not authorized to access. (c) Using credentials
for which Client is not authorized to log into a server,
account, or network which the Client does not have authorization
to access. (d) Attempting to breach, performing actions that
may lead to the breaching or successfully breaching security
or authentication protocols and measures without the express
written authorization of eVise. (e) Scanning, probing, or
testing the vulnerabilities of any server, system, network
or infrastructure. (f) Performing any action which results
in, or in order to obtain services which the Client is not
authorized or entitled to obtain. (g) Interrupting, interfering
or the attempt interrupt or interfere with service to any
user, system, server, host, network, Client or infrastructure
including, without limitation, by means of "denial of
service", "overloading," "flooding," "mailbombing," "crashing", "blocking", "spoofing", "terminating", "controlling", "shadowing",
or "redirecting". (h) Aid or abet any individual
or organization engaging in any of the above.
"SPAM" - Unsolicited Advertising: The posting of
unsolicited or inappropriate e-mail messages, bulk communication
or announcements
to one or more parties is prohibited. Users of any type are
prohibited from: (a) Sending, forwarding or posting messages
to recipients who have previously notified or indicated that
such messages are not wanted or welcome. (b) Sending, forwarding
or posting excessive messages or which may be considered
as intended to harass, annoy, or provoke. (c) Misrepresenting,
removing, omitting, deleting, hiding, or forging message
or transmission data, which includes return addresses, server
identifications and headers. (d) Sending messages with forged
message header or packet header data (e) Perform any actions
with the intent of hiding, misrepresenting, or shielding
the identity or contact details of the Client. (f) Aid or
abet any individual or organization engaging in any of the
above.
Hosted Content: Client is and will remain responsible for
all of the content hosted by eVise for said Client. eVise
accepts no responsibility for the content of the information
passing through the eVise Infrastructure. This includes content
provided by or on any third-party web sites linked to or
through the eVise Infrastructure. Links to web sites that
may be provided are Internet navigation tools, and are for
informational purposes only. Any and all links on the eVise
Infrastructure are not to be considered an endorsement by
eVise of the topics or contents of those web sites. eVise
will not accept responsibility for, or warrant the accuracy
of content from any web site, linked or otherwise. Use of
any information encountered or obtained via the eVise Infrastructure
is at Client's own risk. eVise does not monitor or screen
Client communications and can not be held responsible for
screening or monitoring, or the lack of screening or monitoring
content used by Client.
Consequences of Acceptable Use Policy Violation: eVise reserves
the right to terminate, disconnect, discontinue, suspend
or take any other appropriate action on all Client accounts
used to violate this Policy or laws of any kind.
Indirect or attempted violations of this Policy, and actual
or attempted violations by a third-party on behalf of a Client,
will be considered violations of this Policy by such Client.
Furthermore, it is a violation of this Acceptable Use Policy
to use the services of another provider for the purposes
of facilitating any of the activities described above if
such use of another provider's service could reasonably be
expected to affect the eVise Infrastructure.
Questions or Comments: If there are any questions or comments
regarding this policy or the prohibited and allowed use of
the eVise Infrastructure, it is the sole responsibility of
the client to verify the policy before potential violations
